The State Does
Have the Right to Stop Illegal Immigration!
February 11, 2007
While I'm thinking about it, I'd like to point out that we should stop and correct people and the media at every occasion possible when they (or a media article) use the terminology "undocumented worker" or even "illegal immigrant". The proper term is "illegal alien". People coming into the country illegally ARE NOT IMMIGRANTS! Immigration is a process of entering legally for the purpose of becoming a citizen, NOT entering illegally for a temporary job, obtaining the unearned benefits of citizenship and exporting money to a foreign country, ALL to the detriment and at the cost of the host country and its citizens!
The term "alien", in the sense of residence, means "alien to a country's culture", a person foreign to the country's citizenship. The term, "illegal alien" is the ONLY real description of such persons!
Further, we keep hearing that the State can do nothing to stop "illegal aliens" because "immigration policy" is a federal power under the Constitution. --- BUT illegal entry IS NOT IMMIGRATION POLICY; the process of legal immigration is federal policy!! Where the federal government derives its power for legal immigration is in Article I, Section 8, Paragraph 4 which states, “[The Congress shall have Power] to establish an uniform Rule of Naturalization… --- The Constitution provides no exclusive federal power to permit, or prevent "illegal entry", though it DOES REQUIRE in Article IV, Section 4, that the United States "protect each of them (States) against Invasion", but WITHOUT exclusivity!
Under the Tenth Amendment, "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people." Therefore, the States DO HAVE THE POWER to stop "illegal entry"!!!! --- And if the States DO NOT take such power, it is the right of the people to exercise that power!!!
Hence, the validity of the "Minutemen"!!!
I should have added that Article I, Section 10, Paragraph 4, states that, "No State shall.... engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay." --- We are at WAR and we are being Invaded by masses on illegal aliens, and the Danger will not admit of delay!
